An application for the provisional Business Innovation and Investment Subclass 188 visa, Significant Investor stream, would be the first step in this journey.
As part of the application process, you will need to
- submit an Expression of Interest in SkillSelect;
- be nominated by a State or Territory government agency, or Austrade; and,
- be invited by the Department of Home Affairs to apply for the Subclass 188 visa.
The Business Innovation and Investment Subclass 188 visa is thus a State nominated 5-year provisional visa, with a pathway to permanent residency through the Business Innovation and Investment (Permanent) Subclass 888 visa.
In Queensland, State nomination for this visa is managed by the Queensland Government, through Migration Queensland, in collaboration with the Department of Home Affairs.
To be nominated by Queensland, you need to have a genuine intention to live in that State. You must demonstrate a genuine commitment to Queensland.
You will need to invest at least $5 million that meets certain requirements and have a genuine intention to hold that investment for the life of your provisional visa.
Also, to be considered for Queensland nomination, you must first meet eligibility criteria of the Department of Home Affairs, as well as meet the Migration Queensland criteria.
Amongst the requirements, you will need to satisfy the following:
- Have net assets of at least $5,000,000, which will be invested in complying investments, as follows:
- 20% in venture capital and growth private equity funds that invest in start-up and small private companies
- 30% in approved managed funds that must invest in emerging companies listed on the Australian stock exchange.
- 50% in balancing investments of managed funds.
The managed funds may invest in a range of assets, including companies listed on the Australian stock exchange, Australian corporate bonds or notes, annuities and commercial real estate.
However, direct investment in residential real estate is prohibited. Indirect investment in residential property through managed funds is strictly limited. Also, you must not use investments as security or collateral for a loan.
After holding the provisional Subclass 188 visa for 3 years, you may be eligible to apply for the permanent Subclass 888 visa.
