- Prosecutions by the Department of Immigration and Border Protection (DIBP), Association of Superannuation Funds of Australia (ASFA) and the Australian Taxation Office (ATO).
Our team of highly skilled criminal lawyers and multi-disciplined law practitioners provide experienced advice and are equipped to guide you through the entire process, focusing on what you need to do in the future to defend charges and/or reduce any sentence that may be imposed.
Our priority is always the best possible outcome for our Clients.
We advocate for Clients in the Supreme, District and Magistrates Courts of Queensland and have experience in attacking the validity of legislation in the High Court of Australia. Irish Bentley Lawyers are the primary critic of the VLAD regime and were personally invited to provide our guidance as to what the current government should do with the controversial “Bikie Laws”.
That’s why we promise to fight for you, to be upfront with you, and to guide you through every step.
We offer 24 hour emergency legal assistance, and also offer a $330 fixed price consultation to discuss any matter, so that you can get affordable advice on what you are facing, how to deal with it, and what it will cost.
For urgent matters, our Solicitor Chris Main can be contacted on 0438 803 874.
VLAD REGIME AND ANTI-BIKIE LAWS
We are the pre-eminent Brisbane Law Firm tackling the Newman Government’s attack on the liberties of the citizens of the State. We are proud to have achieved a favourable result for Queensland in our High Court challenge which essentially made the VLAD amendments unenforceable. Visit our FACEBOOK page.
We are currently involved in litigating a number of these matters in other Courts. To date, Irish Bentley has successfully resisted all prosecutions brought often with costs orders of $30,000.00. We have also successfully defended local businesses (especially tattoo parlours) that have fallen victim to the VLAD regime.
As a result, we have an in-depth and exclusive understanding of the new laws, the overlapping constitutional and treaty issues, and how the laws must be tackled (and in particular bail applications).
WHITE COLLAR CRIME
Our strong commercial law links enable us to consider the other implications of any charges, and in particular to act in any matters requiring experience in trade practices matters, offences brought under the Corporations Acts, and any other “white-collar” matters.
Our lawyers have post graduate qualifications in insolvency law, and defending prosecutions brought by the ACCC, ASIC, and ITSA (now ASFA).
This experience ensures all issues are considered, and allows us to raise arguments in criminal matters, which are only used in commercial law matters.
The breadth of experience and focus on the Client’s desired outcome, sets us well and truly apart from conventional criminal law firms.

- In 2013, the Firm was selected to represent Stefan Kuczborski and the UMCQ (United Motorcycle Council of Qld) in the constitutional challenge to the High Court to have the VLAD law declared invalid set aside. This action required us to argue against amendments to some 30 different pieces of legislation, and to traverse international treaty obligations and the most challenging area of law possible.
We acted against the State Government of Queensland, New South Wales, Victoria, South Australia, Western Australia and the Northern Territory.

- Challenging the refusal to grant tattoo licences to tattoo parlours (we see no good reason to stop legitimate businesses operating in the skin art business).
- Challenging the refusal to tattoo licences to artists (which is preventing many decent hard working people who have no other way of making an honest living from working).
- Defending the right of Incorporate Motorcycle Clubs from having their incorporation cancelled by a Campbell Newman interpretation of a Joh Bjelke-Petersen Law.
