What do I do if the BSA cancels my license?

Introduction:

If you or your company become insolvent, then your BSA license can be cancelled (for between 5 years and life) unless you apply to the QBSA within 28 days of receiving notice.

It is wise to contact us before the BSA notify you, so that we can prepare ASAP.

Please contact us if you are made bankrupt, or if your company is for it to be reinstated (or if either event is likely or imminent).

More detail on what will happen to your BSA license:

If you are a licensed builder then you can lose your BSA license for five years:

1.      if you are declared bankrupt; or

2.      if you are a director, secretary or influential person of a company that is wound up.

If both occur, then the QBSA has the power to exclude you for life.

The Queensland Building Services Authority (QBSA) monitors the bankruptcy and corporate insolvency lists to ensure that licenses are cancelled promptly, so you need to act quickly if you want to apply for your license to be reinstated.

The relevant legislation is section 56AC of the Queensland Building Services Authority Act 1991 (Act), and the relevant terminology used relates to “Excluded persons” and” permitted Individuals.”

What can you do to protect/ reinstate your license?

Basically, you will need to apply to the QBSA to have your license reinstated within 28 days of receiving the notice from the QBSA (that they intend to deem you to be an excluded individual).

If the QBSA decides against the application, then you can apply for a review of that decision through the Queensland Civil and Administrative Tribunal (QCAT).
